Outlines permitted and prohibited uses for network, infrastructure, and platform resources.

Acceptable Use Policy Overview

  • This Acceptable Use Policy (AUP) governs all usage of FREAKHOSTING services, products, platforms, infrastructure, and networks. By using our services, you agree to comply with this policy, our Terms of Service, all supplemental agreements, applicable local and international law, and all FREAKHOSTING guidance.
  • Any actual or attempted violation may result in immediate suspension, restriction, or termination of your services, loss of data, legal action, account blacklisting, financial penalties, and permanent bans without refund or prior warning.
  • FREAKHOSTING reserves the right to interpret, revise, enforce, suspend, or terminate services per this AUP, including retroactive enforcement, at its sole discretion, with or without notice.
  • Users must regularly review the current AUP. Continued use of FREAKHOSTING services constitutes ongoing acceptance of all terms and amendments.
  • If your service is suspended, terminated, or blacklisted due to an AUP violation, you are not eligible for a refund. All payments made prior to or after the reported incident will not be refunded, and FREAKHOSTING is under no obligation to offer any compensation or reimbursement in these circumstances.

General Prohibitions and Unlawful Use

  • Services may not be used for any criminal, fraudulent, abusive, deceptive, malicious, or unlawful activities in any jurisdiction affected by your data or users. Breaching any law, regulation, court order, or third-party rights is strictly forbidden.
  • Strictly prohibited: hacking, unauthorized access, intrusion attempts, phishing, impersonation, identity theft, scams, mule operations, money laundering, financing or promotion of terrorism, organized crime, or distribution of illegal/regulated/hazardous goods or services.
  • Any form of unauthorized data harvesting, scraping, brute-force, password guessing, dictionary attacks, or social engineering is forbidden.
  • Hosting, sharing, facilitating, or linking to obscene, defamatory, libelous, harassing, hateful, violent, exploitative, menacing, threatening, or inciting content, including content that encourages breaking the law, violence, or discrimination.
  • It is a violation to aid, encourage, conspire, instruct, or enable another party to commit actions forbidden under this AUP.

Prohibited Email, Messaging, and Communication Activities

  • All forms of spam are prohibited: sending or facilitating unsolicited bulk email, commercial email, SMS, chat, or instant messages; mailing list abuse; use of third-party lists without explicit, verifiable opt-in consent.
  • You must comply with applicable laws (e.g., GDPR/UK GDPR, PECR, CAN-SPAM) including truthful sender info, clear identification, working unsubscribe, and timely honoring of suppressions.
  • Phishing, fraud, business email compromise, spoofing, domain/header forgery, or operating as a drop point for phishing, scams, or malware is prohibited.
  • Mail bombing, chain letters, pyramid schemes, open relay operation, misconfigured autoresponders, excessive bounce-backs, or bulk notifications that impact system/network stability are forbidden.
  • Harvesting of contact information, scraping of emails for unsolicited communication, or address book mining is strictly prohibited.

Network, Platform, and System Abuse

  • No unauthorized port scanning, sniffing, mapping, eavesdropping, traffic analysis, or interception of other users’ data. Testing, scanning, or auditing FREAKHOSTING systems without prior written permission is strictly forbidden.
  • Use, distribution, storage, or development of hacking tools, exploit kits, ransomware, spyware, rootkits, droppers, or malware of any kind is not permitted.
  • Hosting, distributing, or operating malware infrastructure (including botnet, C2, CNC, phishing kits, ransomware distribution) will result in immediate and permanent termination and possible legal escalation.
  • Launching, facilitating, organizing, or supporting any DoS/DDoS, bandwidth flooding, protocol abuse, reflection/amplification, or other network-disruptive activity is prohibited.
  • IP spoofing, BGP/route manipulation, ARP/DNS poisoning, packet forging, or attempts to conceal/forge true origin/routing information are prohibited.
  • Attempting to bypass, disable, or interfere with monitoring, logging, throttling, abuse-prevention, or enforcement mechanisms is grounds for immediate enforcement.

Fair Usage Policy and Bandwidth Management

  • FREAKHOSTING may offer generous, unmetered, or “unlimited” bandwidth plans on a Fair Usage basis intended for ordinary business use, subject to ongoing compliance with this AUP.
  • Excessive or unfair usage includes (illustrative, not exhaustive):
    • Sustained average usage > 100 Mbps for more than 3 continuous hours or repeated peaks (3+ per 24h) >500 Mbps
    • Consumption exceeding 5 TB (IN + OUT) within 30 days (unless you purchase additional bandwidth)
    • Any usage pattern that materially impacts other users, network stability, or FREAKHOSTING infrastructure
    • Activity significantly departing from statistical norms for comparable services

  • Forbidden: public VPN/proxy operation, TOR exit/relay, high-volume CDN edge, mass crawling, sustained backup/sync, peer-to-peer warehousing, media streaming farms, file mirrors, open relays/resolvers, DDoS reflectors.
  • Network/resource abuse including persistent syncing, automated scraping/crawling, seedboxes, or remote backup without written approval is forbidden.
  • FREAKHOSTING may throttle, limit, suspend, or require plan upgrades; technical/resource controls may be applied at our discretion to protect the platform.
  • Sustained or repeated breaches, or uses causing upstream/transit complaints, will trigger immediate enforcement.
  • Bypassing/obscuring true traffic patterns or misuse of alternate protocols/applications to evade limits is forbidden.

Resource, Bandwidth, and Service Abuse

  • Resources must support normal website, email, or business app functions relevant to your account. Public file shares, mirrors, storage buckets for third-party distribution, mass crawling, traffic generators, artificial metric tools, or any “abnormal load” activities are forbidden.
  • Accounts are confidential: you may not resell, lease, sub-allocate, share, or provide public/third-party access except where explicitly allowed (e.g., permitted sub-accounts or staff roles).
  • All “unlimited” plans are subject to internal benchmarks and must align with “normal and intended use” as set by FREAKHOSTING. Excessive/irregular usage or commercial reselling/aggregation may trigger enforcement or surcharges.
  • Cloud sync/backups at scale, remote file hosting, distributed computing, or cryptocurrency mining (including PoW, PoS, or similar) are strictly forbidden.
  • Any script/tool/automation used to bypass or defeat quotas, usage caps, or limits (including via proxies, VPNs, or identity obfuscation) will trigger enforcement.

Data, Content, and Compliance

  • All hosted data/content must be lawful, non-defamatory, and must not infringe third-party intellectual property, trademark, patent, or copyright rights.
  • You may not host, store, transmit, or make available pirated/copyrighted works, unauthorized software/files, or circumvent licensing/DRM protections.
  • Data must be directly related to the hosted website or allowed client application. Unrelated, hidden, covert, or misleading files may be removed, archived, or reported.
  • Hosting, transmitting, or processing adult content, gambling, virtual currencies, pharmaceuticals, weapons, or other regulated materials without specific written agreement is forbidden.
  • Zero tolerance: child exploitation, illegal pornography, doxxing, hate speech, violent threats, targeted discrimination, terrorist propaganda, revenge porn, or any material causing harm or violating law. Offenders will be reported to authorities.
  • Any data or content that may breach privacy or data-protection law (e.g. GDPR/UK GDPR, CCPA) may be restricted or removed as required.
  • Any data or content that may breach DMCA may be restricted or removed as required.

Security, Account Responsibilities, and User Conduct

  • You are fully responsible for all actions through your account, whether by yourself, authorized users, or any device/tool/script you deploy.
  • Using weak/default/shared passwords, neglecting security patching, or failing to implement robust access control is a violation.
  • Keep credentials private, use secure authentication (e.g., MFA where available), and notify us immediately of any suspected breach or unauthorized access.
  • You shall indemnify and hold harmless FREAKHOSTING for any damages, losses, penalties, claims, or costs (direct or indirect) resulting from your breach of this AUP.
  • Users must cooperate with investigations and respond promptly to abuse inquiries/takedowns. Failure to cooperate may result in suspension or blacklisting.

Game Servers and Modded Content

  • Custom modpacks, plugins, and binaries are customer-supplied and unsupported for performance or compatibility guarantees.
  • Distributing proprietary or unlicensed game assets is prohibited. Respect the game publisher’s EULA and mod/plugin licenses.
  • Server discovery spam, fake player injection, traffic manipulation, or artificial metrics are prohibited.

Penetration Testing and Vulnerability Disclosure

  • Penetration tests, scans, or security research targeting FREAKHOSTING systems require prior written authorization. Unauthorized testing is prohibited.
  • If you discover a vulnerability, do not publicly disclose it; report it to us privately with enough detail to reproduce. We will assess and remediate as appropriate.
  • Exploiting vulnerabilities, accessing data unlawfully, or disrupting services is prohibited under this AUP.

IP Address, DNS, and Reputation

  • IP assignments are non-portable and remain FREAKHOSTING property. Use only the IPs assigned to you; do not announce or advertise routes without authorization.
  • We do not guarantee deliverability or IP reputation. Listings on third-party blocklists are outside our control; remediation may require configuration changes or paid IP replacement.
  • Misuse of DNS, open resolvers, spoofed records, or misleading geolocation data is prohibited.

Export Controls, Sanctions, and Restricted Jurisdictions

  • You may not use our services in violation of applicable export control, sanctions, or embargo laws (including U.K., E.U., and U.S. regimes) or provide services to sanctioned parties/entities.
  • You warrant you are not located in, resident of, or ordinarily resident in a restricted jurisdiction and are not subject to government-issued restrictions that would prohibit use of our services.

Copyright Notices and Takedown (DMCA/Equivalent)

  • We respond to properly formatted copyright claims and legal notices. Upon receipt, we may remove or disable access to the reported material and notify the account holder.
  • Repeat infringement may lead to suspension or termination. Submitting fraudulent or abusive claims is prohibited and may result in liability.

Lawful Requests, Data Preservation, and Disclosure

  • We may preserve logs and disclose account information/content when required by law, court order, or to prevent imminent harm.
  • In emergencies involving risk to life or safety, we may act without prior notice and disclose limited data to competent authorities consistent with applicable laws.

Resellers and End-Customer Responsibility

  • Resellers are responsible for their end-customers’ compliance with this AUP. Violations by end-customers are deemed violations by the reseller.
  • Resellers must provide timely abuse contacts, ensure accurate WHOIS/DNS records, and promptly process takedown/abuse requests.

Abuse Reporting, Investigation, and Enforcement

  • FREAKHOSTING may monitor, log, audit, and review hosted activity/content to identify abuse or security threats. Any content or resource in breach may be disabled, removed, or confiscated at our discretion.
  • We cooperate with lawful legal, regulatory, law-enforcement, and anti-abuse entities. User/customer data may be disclosed in compliance with legal procedures or to prevent harm.
  • Repeated, intentional, or egregious violations, evasion, or failure to cooperate in abuse investigations will result in permanent account closure and blacklisting.
  • Technical or legal enforcement actions may occur without prior notice, including suspension, data deletion, or service bans. Reinstatement may require remediation proof, contractual commitments, and payment of a reinstatement or investigation fee.

Modification, Interpretation, and Final Authority

  • FREAKHOSTING may update, modify, or replace any part of this AUP, Terms of Service, or any guidelines at any time and for any purpose. Changes take effect upon publication.
  • Users are responsible for checking the latest AUP/Terms and are deemed to have accepted revisions through continued use.
  • All interpretation, enforcement, and application of this AUP rest solely with FREAKHOSTING. All FREAKHOSTING decisions are final.
